Terms of Service
These Terms of Service (“Terms”) govern your access to and use of FounderCards (the “Service”), a digital product that generates a wallet pass and a hosted holographic founder card. By using the Service or purchasing a card, you agree to these Terms.
1. Who we are
FounderCards is operated by Dmytro Virych, an individual sole proprietor based in Ukraine (“FounderCards”, “we”, “us”). You can reach us at support@founder-cards.com.
2. The Service
FounderCards lets you create a personalized founder card. A purchase generates two artifacts: (a) a digital wallet pass compatible with Apple Wallet and Google Wallet, and (b) a hosted card page at a permanent URL together with a high-resolution PNG download. The Service is sold as a one-time charge per card.
3. Eligibility
You must be at least 18 years old to purchase the Service. You agree to provide accurate information when creating your card and to keep your contact email up to date so we can deliver your purchase.
4. Accounts
The Service does not require a traditional account. Purchases are tied to the email address you provide at checkout and to the unique URL of the card you generate. Keep that link safe — anyone with the link can view the public card page.
5. Acceptable use
You agree not to:
- Impersonate another person, company, or brand when creating a card.
- Submit content that is illegal, defamatory, infringing, hateful, or sexually explicit.
- Resell, redistribute, or sublicense wallet passes or card pages generated for you.
- Attempt to disrupt, reverse-engineer, or abuse the Service or its infrastructure.
We may suspend or remove cards that violate these rules and may refuse service at our discretion.
6. Payments, pricing, refunds
Payments are processed by our payment provider, Creem. We do not store full payment card details on our servers. Prices are shown in USD at checkout and may change for future purchases.
We offer a refund within 7 days of purchase if the card has not yet been minted and the wallet pass has not been downloaded. To request a refund, email support@founder-cards.com from the address used at checkout.
7. Intellectual property
You retain ownership of the content you submit (your name, stats, profile picture, etc.). By submitting content, you grant FounderCards a non-exclusive, worldwide, royalty-free license to host, display, and process that content for the purpose of operating the Service and delivering your card.
FounderCards, including the card designs, templates, archetypes, and underlying software, is our intellectual property. Your purchase grants you a personal, non-transferable license to use the wallet pass and PNG download we generate for you. You may share screenshots and the public card URL freely.
8. Third-party services
The Service relies on third-party providers including Apple Wallet, Google Wallet, Creem (payments), Resend (transactional email), Supabase (database hosting), and Vercel (application hosting). Your use of those services is also subject to their own terms.
9. Disclaimer
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
10. Limitation of liability
To the maximum extent permitted by law, FounderCards shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, arising out of or related to your use of the Service. Our total liability for any claim arising out of or related to the Service shall not exceed the amount you paid us in the twelve months preceding the claim.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your access — and remove your card page — if you violate these Terms or if we reasonably need to protect the Service or other users. Sections that by their nature should survive termination (intellectual property, disclaimer, limitation of liability, governing law) will survive.
12. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the “Last updated” date above. Material changes will be communicated by email or via a notice on the Service. Continued use of the Service after changes take effect constitutes acceptance.
13. Governing law and venue
These Terms are governed by the laws of Ukraine, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service shall be brought exclusively in the courts of Ukraine, unless another venue is required by mandatory consumer protection law in your jurisdiction.
